These Terms of Service ("Terms") govern your access to and use of the Zoye.ai platform available at https://zoye.ai (the "Service"), operated by Piotr Zapolski Web Development, ul. Cybernetyki 2B/124, 02-677 Warsaw, Poland, NIP: 5811976789, REGON: 523629115 ("Provider", "we", "us", or "our").
By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and, where applicable, the Data Processing Agreement.
To use the Service, you need a device with internet access, a modern web browser (Chrome, Firefox, Safari, or Edge — latest two major versions), and a valid email address. The Provider is not responsible for inability to use the Service due to failure to meet these requirements.
Registration is free and requires providing a valid name and email address. By registering, you represent that you are at least 18 years of age and that all information provided is accurate and current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
The Provider reserves the right to suspend or terminate accounts that violate these Terms, are used for unlawful purposes, or remain inactive for an extended period.
Access to certain features requires a paid Subscription. Subscriptions are billed in advance on a recurring basis (monthly or annually) according to the plan selected. Your Subscription renews automatically at the end of each billing cycle unless cancelled before the renewal date.
A valid payment method is required. By providing payment information, you authorize us to charge all applicable fees. Payments are processed by third-party payment processors (such as Stripe). We do not store your payment card details.
All prices are displayed in the currency indicated at checkout and are exclusive of applicable taxes unless otherwise stated.
We may offer a Free Trial at our discretion. At the end of the Free Trial, unless you cancel, you will be automatically charged for the selected Subscription plan. We reserve the right to modify or discontinue Free Trial offers at any time without notice.
We may modify Subscription fees at any time. Fee changes take effect at the start of the next billing cycle. We will provide at least 14 days' prior notice of any fee increase. Your continued use of the Service after a fee change constitutes acceptance of the new pricing.
Refund requests are considered on a case-by-case basis at our sole discretion. To request a refund, contact us at hi@zoye.ai.
You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:
The Service processes Customer Data, including messages from your end users, using artificial intelligence. You retain ownership of all Customer Data. By using the Service, you grant us a limited license to process Customer Data solely for the purpose of providing and improving the Service.
Where you upload or process personal data of your end users through the Service, you act as the Data Controller and we act as the Data Processor. The processing is governed by the Data Processing Agreement.
The Service and its original content, features, and functionality are and remain the exclusive property of the Provider. The Service is protected by copyright, trademark, and other applicable laws. You may not use our trademarks or trade dress without our prior written consent.
If you are dissatisfied with the Service, you may submit a complaint by email to hi@zoye.ai. Please include a description of the issue and your account details. We will acknowledge your complaint within 3 business days and endeavor to resolve it within 14 calendar days.
Technical support is available via email during business hours (Monday to Friday, 9:00–17:00 CET). Support scope is limited to issues directly related to the Service's functionality. We do not provide support for third-party integrations, custom code, or issues arising from failure to meet technical requirements.
You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms.
Upon termination, your right to use the Service ceases immediately. We may retain Customer Data for up to 30 days after termination, after which it will be permanently deleted unless otherwise required by law.
To the maximum extent permitted by law, the Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising from your use of the Service. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount paid by you to us in the 12 months preceding the claim.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. AI-generated responses are provided for informational purposes and should not be relied upon as professional advice.
We reserve the right to modify these Terms at any time. We will notify you of material changes at least 14 days in advance via email or a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you disagree with the changes, you must stop using the Service and terminate your account.
These Terms are governed by the laws of the Republic of Poland. Any disputes arising from these Terms shall be resolved by the competent court for the Provider's registered address, unless mandatory consumer protection laws provide otherwise.
Consumers within the European Union may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
